France Travel Solutions Cancellation and Refund Policy

Effective from: 08/08/2022

1. General

(a) In this cancellation policy (Cancellation Policy), ‘FTS’, ‘us’, ‘we’ or ‘our’ means France Travel Solutions (ABN 37 936 297 869).

(b) France Travel Solutions attempts to ensure that any Customer (‘Customer’, ‘you’ or ‘your’) only books Services that will meet their expectations. This policy sets out the circumstances in which we may permit cancellation of part or all of a Booking and/or Services.

(c) This Cancellation Policy incorporates our General Terms and Conditions, Privacy Policy and Website Terms of Use.

(d) Any capitalised term has the meaning given in the Terms.

(e) To the extent of inconsistencies, this Cancellation Policy will prevail over the General Terms and Conditions.

(f) Nothing in this policy limits your statutory rights under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.

2. When FTS will not agree to a cancellation request

Circumstances that do not qualify for cancellation include:

  • Failure to read the Terms
  • Change of mind after booking
  • Booking or Service matched its description but did not meet expectations
  • Third-party providers met description but not expectations
  • Performance prevented due to your own action, inaction, or negligence (e.g., missing transport, illness, or failure to comply with requirements)

FTS assesses each cancellation request case by case.

3. Events amounting to cancellation

Events that may constitute cancellation (and incur fees) include:

  • A Force Majeure Event
  • Actions or inactions by persons or authorities beyond the Customer’s control that prevent performance

4. Cancellation of all or part of the Services / Booking

(a) Where a Customer cancels, cancellation fees apply as a reasonable reflection of losses.

(b) Fees may be up to 100% of the Price, regardless of whether the Tour has commenced.

(c) Cancellation fees:

  • More than 120 days before Tour Start Date: 10% of Price
  • 119–60 days before Tour Start Date: 50% of Price
  • 59 days or less before Tour Start Date: 100% of Price

(d) Transfer to another individual incurs fees as indicated by FTS and any supplier charges.

(e) No fee applies if cancellation is due to FTS’ material breach (and not remedied within 20 business days of notice).

5. Submitting a cancellation request

Requests must be submitted via email: maud@francetravelsolutions.com.

All requests are non-reversible once received unless FTS agrees otherwise.

6. Liability

(a) To the extent permitted by law, we are not liable for injury, loss, delay, or inconvenience caused by third-party providers, Force Majeure, or other uncontrollable events.

(b) Where liability cannot be excluded, it is limited as required under Australian Consumer Law.

7. Other matters

FTS may agree to cancellations outside of the above circumstances in extenuating cases, at our discretion.

8. Verification

FTS may verify the details of a cancellation request and ask for additional information.

9. Refusal

FTS may refuse requests deemed invalid, misleading, or fraudulent. Suspicious activity may be referred to authorities.

10. Refund via direct deposit or credit

Refunds may be issued either:

  • Directly to your bank account
  • As a credit note to your email

Refunds/credits are at FTS’ discretion. Credit notes must be redeemed before expiry and cannot be redeemed for cash.

11. Credit note terms and conditions

  • Valid until expiry date on credit note
  • May be used for one or multiple bookings
  • No additional FTS booking fees (supplier fees may apply)
  • Non-refundable, non-transferable, not cash or gift card
  • Cannot be combined with other offers
  • Remain FTS property and subject to conditions

By accepting a credit note, you agree it replaces any refund entitlement. You release FTS from related claims. FTS may refuse or cancel credit notes obtained fraudulently.

12. Change to Cancellation Policy

FTS may amend this policy at any time by posting updates on our website. Significant changes may also be notified via email or notices on the homepage.
